§ 1. INTRODUCTION

  1. The Terms and Conditions have been issued pursuant to Article 8(1)(1) of the Act of 18 July 2002 on Electronic Provision of Services and shall be made available free of charge in a form that enables their downloading, recording and printing.
  2. The Terms and Conditions set out the general principles and technical requirements for using the Website, the rules for entering into and terminating the Agreement, intellectual property rights and the complaint procedure.

§ 2. DEFINITIONS

  •  Service Provider - the Website administrator, one.bid sp z o. o. with his registered office at ul. Franciszka Klimczaka 17/107, 02-797 Warsaw, Poland, on the basis of the entry in KRS 0000914354, VAT id: PL7122494202.
  • User - a natural person, legal person or organisational unit without legal personality, who has entered into a contract with the Service Provider for the electronic provision of services available on the Website under the principles set out in the Terms and Conditions and the applicable legal regulations.
  • Website - an IT solution available at the web address onebid.pl and possibly at other web addresses, comprising an online auction platform that enables Users provided with appropriate end devices to conclude Transactions and participate in Auctions.
  • Application - a computer program (mobile application) installed on the User's mobile device (smartphone), available for the Android, iOS and Huawei operating systems, forming part of the Website; when the Terms and Conditions refer to the Website, this shall also mean the Application.
  • Auction - a public sale of a Lot organised by the Auction House, conducted in the form of bidding in which the person offering the highest price becomes the buyer.
  • Purchase Price - the final amount that the buyer is obligated to pay for a Lot. It consists of the hammer price, the auction fee and additional fees resulting from the catalogue designations of the lot.
  • Starting Price - the amount at which Bidding starts.
  • Personal Data - all information identifying a natural person, as well as device IP, location data, an online identifier, including information collected through cookies and other similar technology, collected by the Service Provider and processed by him under the principles set out in the Terms and Conditions and the Website Privacy Policy.
  • Auction House - an entrepreneur cooperating with the Service Provider, usually engaged in the trading of antiques, works of art or other collector's items, offering access to Auctions or conclusion of Transactions on the Website.
  • Consumer - a natural person who makes a legal transaction with the Service Provider which is not directly related to their business or professional activity.
  • Account - a set of resources and rights assigned to a particular User on the Website, designated with a unique name (login) and protected with a password. The process of authorising access (logging in) to the resources of the Account requires a login and password.
  • Bidding - a procedure aimed at entering into a Contract for Sale initiated by the Auction House, in which the User declares the price for which they are ready to purchase a Lot. Bidding usually takes place "upwards" by increments.
  • Limit - a User's order for automatic bidding on a particular Lot handled on their behalf by the Service Provider, up to the specified amount.
  • Newsletter - a free electronic distribution service provided by the Service Provider via e-mail, which enables all its users to periodically and automatically receive information about products offered by the Service Provider, news, promotions, contests and events, provided under the principles set out in the Terms and Conditions.
  • Lot - an item offered for sale by the Auction House via the Website or put up for an Auction.
  • Offer - an invitation to conclude a Contract for Sale, prepared and posted on the Website by the Auction House, including a description, photographs and the Starting Price or the Purchase Price of a Lot.
  • Automatic Bid - a User's order for automatic bidding on a particular Lot before the start of an Auction or during live bidding up to the amount specified by the User.
  • Payment Processor - an entity specified on the Website that operates the system for making electronic payments.
  • Raise - User's submission of a bid during live bidding for a specific amount, which is the next permitted increment of the current price of the Lot being bid for.
  • Increment - an amount by which the price of a Lot changes during Bidding.
  • Entrepreneur with Consumer Rights - a natural person entering into a contract with the Service Provider, which is directly related to his/her business activity, when according to this contract, it is not of professional nature for such person, in particular taking into account the object of his/her business activity, made available on the basis of the provisions on the Central Registration and Information on Business.
  • Terms and Conditions - these Terms and Conditions.
  • Auction Terms and Conditions - the Auction House terms and conditions setting out the principles for conducting and participating in an Auction, as well as the terms and conditions for entering into Contracts for Sale and delivering the Lots purchased.
  • Sign-up - an action consisting in the provision by the User and then saving in the IT system of the Website of the required Personal Data, necessary to obtain access to specific resources of the Website. The Sign-up process includes, among other things, choosing an appropriate login and password, providing first name and surname, contact address, e-mail address and data necessary to issue a VAT invoice, if any.
  • Transaction - a Contract for Sale of a Lot entered into between the User and the Auction House via the Website.
  • Agreement - an agreement for the provision of agency services in the Transaction or technical services that enable participation in an Auction, entered into between the Service Provider and the User upon commencement of use of the Website and acceptance of the Terms and Conditions.
  • Contract for Sale - a contract for sale of a Lot within the meaning of Article 535 of the Civil Code, entered into between the Auction House and the User.
  • Services - all services provided by the Service Provider by electronic means on the Website, in particular those enabling the User to use the Website, including participation in Auctions and placing Orders.
  • Order - a declaration of will made by the User via the Website, intended to conclude a Contract for Sale, provided by the Service Provider to the Auction House, identifying the Lot and other information enabling the conclusion and performance of the Contract for Sale.

§ 3. GENERAL PROVISIONS

  1. All rights to the Website, including author's economic rights, intellectual property rights to its name, domain name and materials, shall be vested in the Service Provider, and may only be used in the manner specified in, and in accordance with the Terms and Conditions.
  2. The Website shall be made available by the Service Provider via the Internet as an ICT and IT system resource.
  3. Using the Website shall mean any action that leads to familiarisation with the content presented on the Website.
  4. The User shall be obliged to use the Website in a manner consistent with these Terms and Conditions, applicable law, general principles of using the Internet and in a manner not infringing the rights of the Service Provider or the rights of third parties, from the moment of taking the first action related to the use of the Website.
  5. Effective Sign-up requires thorough reading of the Terms and Conditions and acceptance of their provisions.
  6. It shall be forbidden for the User to provide unlawful content and to use the Website in a manner contrary to the law, accepted principles of morality, infringing personal interests of third parties or legitimate interests of the Service Provider. It shall be unacceptable to take any actions which may hinder or destabilise the operation of the Website or expose the Service Provider to the loss of reputation or good name or to any damage, consisting in particular of the following:
    1. making available any content that is unlawful, harmful, threatening, obscene, violent, abusive, defamatory, vulgar, invasive of another person's privacy, hateful or otherwise objectionable;
    2. impersonating any person or entity, or falsely stating or otherwise misrepresenting one's affiliation with a person or entity;
    3. attempting to disable, impair or destroy the Website;
    4. transmitting, storing or making available any content or code containing viruses, malicious code, malware or any components intended to damage or limit the functionality of the Website;
    5. interfering with or preventing another User from using the services offered on the Website;
    6. posting advertisements of any products or services on the Website without the Service Provider's written consent;
    7. using bots collecting data about auctions;
    8. taking actions that may overload the Website; as well as any other actions affecting the proper functioning of the Website
  7. The Service Provider reserves the right to post on the Website advertising content concerning his own products and services, in the forms used on the Internet.
  8. Apart from these Terms and Conditions, there may be additional terms and conditions that supplement these Terms and Conditions, particularly with respect to additional services.

§ 4. TECHNICAL REQUIREMENTS

  1. The User may use the Website provided that the following technical requirements are met:
    1. having an end device (computer/tablet/mobile phone) allowing access to the Internet, provided with a working operating system,
    2. installing on the device referred to above a web browser providing access to Internet resources, such as: Edge, Google Chrome, Mozilla Firefox, Apple Safari, or any other compatible one supporting cookies,
    3. having an active e-mail account,
    4. having an active mobile phone number.
  2. The technical requirements necessary to use the Services through the Application shall be the same as the above, whereby the Application may only be installed on the User's end mobile device (smartphone) provided with the Android, iOS or Huawei operating system.
  3. In order to participate in an Auction and run the transmission smoothly, an Internet connection with a minimum speed of 3 Mb/s and having a device capable of receiving audio shall be required.
  4. Before using the Website, the User shall be obliged to check whether their device meets the technical requirements specified in the Terms and Conditions. In the case of doubts as to the technical possibilities of using the Website, the User should send a relevant inquiry to the Service Provider to the address:
  5. The quality of transmission of an Auction may depend on the technical parameters of the Internet connection and the technical parameters of the end device used to participate in the Auction.
  6. The Service Provider shall exercise due diligence to ensure that the use of the Website is correct. The Service Provider, however, does not guarantee that there will be no problems with access to the content presented on the Website or transmission of Auctions. Such cases, together with their detailed description should be reported to the Service Provider to the e-mail address: .
  7. The Service Provider informs that technical problems or limitations which occur in the equipment used by the User (firewalls, incorrect versions of web browsers, anti-virus software and others) may limit or prevent the User's access to the services offered on the Website.
  8. The Service Provider via the Website provides services 24 hours a day, 7 days a week throughout the year. The Service Provider reserves the right to maintenance breaks. If possible, the Service Provider shall inform about maintenance breaks and their duration through available means, in particular by posting relevant messages on the Website.
  9. Any actions taken by third parties who have access to the User's end device while the User is actively logged into the Website shall be recorded as actions of that User. The User shall be solely responsible for the consequences of making the end device available to others or leaving it unattended.
  10. The Service Provider shall not be responsible for any problems in the course of an Auction caused by the lack of access to the Internet on the part of the User or the Auction House.
  11. The User acknowledges that the time required to send a data packet and receive feedback (so-called PING) within the online transmission may depend in particular on the capacity of the Internet connection used by the User. Low latency shall not result in apparent limitations of communication, while high PING may result in interference. For this reason, Auction Houses may receive information about a Raise with a delay, and also Raises made by other bidders may be visible to the User only after some time. Likewise, the video feed of an Auction cannot be used as a basis for assessing the current state of bidding.

§ 5. NEWSLETTER SERVICE

  1. As part of the Newsletter Service, the Service Provider shall send to the e-mail address provided an ordered e-newsletter, which informs about news in the field covered by the Services.
  2. The Newsletter subscription service (sending to the provided e-mail address) shall be free of charge and available to all persons who provide their e-mail address through a dedicated form on the Website.
  3. The Newsletter Service may be used by the addressee on condition that they have an active and correctly configured e-mail account.
  4. Each Newsletter from the Service Provider shall contain:
    1. information about the sender;
    2. a filled in "subject" field defining the content of the message;
    3. information on how to unsubscribe from the Newsletter Service or change its parameters.

§ 6. GENERAL CONDITIONS FOR USE OF THE WEBSITE

  1. The User may participate in the Auction or make Transactions only as a result of successful Sign-up on the Website. The User can Sign up and use the Website free of charge.
  2. In order to Sign up, the User should provide the Personal Data marked as obligatory in a sign-up form and then accept the Terms and Conditions and confirm the Sign-up. The User's sign-up on the Website and creation of an individual Account shall be completed at the moment of approval of a sign-up form by the User. From that moment on the User shall be able to log into the Website and use the Services provided through the Website.
  3. Approval of a sign-up form filled in by the User shall be equivalent to their declaration that the data provided in the form is true and that they are entitled to dispose of such data. The User shall be obliged to update their data.
  4. In the case of natural persons it is necessary to have full legal capacity to open an Account.
  5. The User cannot sign up on the Website using a login previously used by another User.
  6. The User shall be obliged to keep the login and access password to their individual Account on the Website confidential.
  7. Access to a User Account (logging in) may be performed through a login form available in the Application or on the Website. The full functionality of the Website shall only be available to logged-in Users.
  8. It shall be forbidden to use Accounts of other Users or to make the Account available, including making the login and password of the User available to other Users and undertaking IT activities or any other activities aiming at gaining access to passwords to Accounts of other Users.
  9. In the case of death of a User being a natural person or liquidation of a User being a legal person or organisational unit without legal personality, the agreement on using the Website resources shall expire. The Account shall be removed by the Service Provider upon notification and demonstration by the authorised person of the circumstances underlying the termination of the agreement.
  10. The Service Provider shall make every effort to ensure that information on prices and descriptions of Lots posted on the Website is presented in accordance with the current facts. In the case of any doubts about the validity of the description or any other issues related to it, the User should contact the Auction House directly.
  11. The photographs of a Lot included in the Offer shall be for information purposes only and may be slightly different from the actual colours, resulting, among others, from the parameters and settings of the User's monitor. The Service Provider is not the author of the photographs of Lots.
  12. In the event of a dispute between the User and the Auction House, the Service Provider shall provide all available assistance to help resolve any discrepancies regarding their positions.

§ 7. CONDITIONS FOR PARTICIPATION IN AN AUCTION THROUGH THE WEBSITE

  1. Through the Website or Application, the Participant may take part in an Auction online, i.e. at a specified time with the use of technology enabling mutual communication between the Auction House and the User in real time ("live").
  2. Lots offered in an Auction shall be put up for sale by the Auction House. The Service Provider shall not be a party to these Auctions, but shall only provide the technical means for Participants to take part in an Auction and Bidding in real time over the Internet together with other persons gathered in the auction room of the Auction House. Neither shall the Service Provider be a party to Contracts for Sale entered into between the User and the Auction House.
  3. Information about the prices of Lots and their descriptions shall be provided by Auction Houses.
  4. The condition for taking part in an Auction shall be the Participant's sign-up for the Auction via the Website and their acceptance of the Auction Terms and Conditions. The Auction Terms and Conditions shall be made available on a sign-up sheet for each auction.
  5. Only Users positively verified by the Auction House based on the Auction House criteria may be admitted to an Auction. Therefore, the User who wants to participate in an Auction, shall sign up for the Auction by providing the Auction House with the personal data required by it in the Website sign-up form, including their first name, surname, address, telephone number, e-mail address and by accepting the Auction Terms and Conditions. The Auction House may refuse to allow the User to participate in an Auction.
  6. The conclusion of a Contract for Sale for the Lot won by the User shall be subject to the conditions specified in the Auction Terms and Conditions.
  7. The method and date of payment of the price, fees for the organisation of the Auction and other fees, as well as the delivery of the Lot shall be determined each time by the Auction Terms and Conditions.
  8. The User winning the Bidding shall be obliged to purchase the item won at the Purchase Price obtained and any other fees provided for in the Auction Terms and Conditions.
  9. Both parties to the Transaction (User and Auction House) shall be obliged to make every effort to complete it.
  10. The Service Provider shall not be responsible for inappropriate behaviour of Users or Auction Houses concerning contracts entered into through the Website. The Service Provider shall not guarantee the closing of Contracts for Sale and shall not be responsible for any defects or quality of Lots.

§ 8. GENERAL RULES ON THE CONDUCT OF AUCTIONS

  1. Before participating in an Auction the User should carefully read the Auction Terms and Conditions.
  2. A live Auction shall be conducted by the auctioneer, who reads out the lots and subsequent increments, indicates the bidders, announces the end of the bidding and indicates the winner. Completion of the bidding shall be equivalent to the conclusion of a Contract for Sale between the Auction House and the highest bidder, in accordance with the conditions specified in the Auction Terms and Conditions. In the event of a dispute during the bidding process, the auctioneer shall either resolve the dispute or re-bid the Lot. Auction Houses may reserve the right to record the course of Auctions using audio and video recording equipment.
  3. Bidding shall start at the Starting Price. The auctioneer may provide subsequent Increments according to the table of increments of the Auction House. Depending on the course of an Auction, the auctioneer may, in accordance with the Auction Terms and Conditions, at their own discretion, decide on a different amount of the increment.
  4. If the minimum price, i.e. the lowest amount for which the Auction House may sell the Lot without the seller's additional consent, is not reached through bidding, the auctioneer may announce the conclusion of a conditional transaction. The possibilities for concluding conditional transactions, i.e. accepting a bid to purchase a Lot at the hammer price as binding, shall be each time determined by the Auction Terms and Conditions.
  5. The User who is unable to participate in an Auction in person may, insofar as provided for in the Auction Terms and Conditions, place bidding orders with a Limit. In the case of two or more orders with the same Limit, the order of submissions sent or the queue of consecutive raises may be decisive, depending on the type of auction.
  6. If an Automatic Bid is submitted for the Lot by several Users, the Starting Price for the Lot made public shall be the lowest possible amount submitted by the User with the highest Automatic Bid.
  7. The final acceptance of the User's proposal shall be subject to the decision of the Auction House; in particular this shall apply to:
    1. the decision on the submission of the same amount by the User participating in the Auction via the Website online and a person bidding in the Auction House room,
    2. the granting or not of the lead in the bidding process to the User who has submitted the same amount by a Limit, Automatic Bid or Raise.
  8. Some items may have a minimum or reserve price and this information is included in the Lot description. The value of this price shall be secret and known only to the Auction House organising the Auction. For the Bidding to end in a sale, the final price must be equal to or higher than this amount. Otherwise, the Lot may be considered unsold or the Bidding may end in a conditional transaction.

§ 9. CONDITIONS FOR PURCHASING LOTS THROUGH THE WEBSITE

  1. The Website makes it possible to make Transactions in order to purchase Lots.
  2. In order to make a Transaction through the Website, it is necessary to:
    1. have an active e-mail account,
    2. read and accept the Terms and Conditions,
    3. correctly place an Order,
    4. pay the Price.
  3. The User shall be a direct party to a Transaction with the Auction House.
  4. The Service Provider shall not be a party to a Transaction with the User. The Service Provider shall make available to the User the technical means and technical support to make it possible.
  5. Lots shall be delivered to Users by third parties on the basis of separate legal relationships to which the Service Provider is not a party.
  6. The Auction House as the seller shall be responsible for the correct delivery of a Lot.
  7. All information contained in the Offer of a Lot put up on the Website, including its description and price, shall not constitute an offer within the meaning of Article 66 of the Civil Code, but an invitation to enter into a contract with the Auction House, within the meaning of Article 71 of the Civil Code.
  8. Entering into a Contract for Sale of a Lot included in the Offer shall be preceded by placing an Order, initiated by the User, with the Auction House via the Website.
  9. In order to place an Order it is necessary to create a User Account.
  10. An Order for a Lot shall be placed by clicking on the "Cart" button.
  11. When placing an Order for a Lot until the User clicks the "Payment" button, the User shall have the possibility of modifying the Order, including the choice of a Lot, in accordance with the messages and information displayed.
  12. An Order shall be placed when the User clicks the "Payment" button and shall be tantamount to submitting a declaration of intent to enter into a Contract for Sale with the Auction House in accordance with the Terms and Conditions.
  13. Once the User has placed an Order and received a confirmation e-mail, it cannot be modified.
  14. The condition for the fulfilment of the User's Order shall be the payment of the price in advance (before receiving the Lot).

§ 10. PAYMENTS

  1. Payment transactions within the Website shall be handled by third-party Payment Processors.
  2. In order for the User to make a payment, a payment card and/or bank account or other payment method operated by the Payment Processor (payment methods) shall be required.
  3. After selecting a payment method, in order to make it the User shall provide the necessary data required by the Payment Processor.
  4. Before making a payment, the User should first read and accept the payment terms and conditions provided by the relevant Payment Processor.
  5. The terms and conditions for the use of the payment transfer services referred to in sub-paragraph 5 above set out the rules of the Payment Processor's liability for the due performance of the payment transfer service and the rules of handling the complaint process related to the payments made in this way.
  6. For some payment methods, the third-party Payment Processor may charge the User additional fees, such as foreign transaction fees or other fees related to the processing of the selected payment method. For more detailed information, the User should contact the Payment Processor who processes the payment.
  7. The prices of Lots contained in each Offer shall be expressed in the currency of the Auction House and shall be total gross prices.
  8. The price of a Lot shall not include delivery costs, which may vary depending on the value of the Lot, its weight, size and place of delivery.
  9. Due to the specific nature of the Lots offered, it is usually not possible to define universal delivery costs. They shall be determined by the User and the Auction House after placing an order.
  10. The price given in the Offer shall be binding for both the User and the Auction House when the User clicks the "Payment" button.

§ 11. ORDER FULFILMENT

  1. The Auction House shall be responsible for the delivery of a Lot.
  2. A Lot shall be delivered against payment, delivery costs shall not be included in the price.
  3. To effect delivery, the Auction House must transfer the User's data to the relevant carrier to the extent necessary for the delivery, and the Auction House must conclude a separate agreement. The Service Provider shall not be a party to agreements with carriers, shall not be able to interfere with their content or manner of performance and shall not be an addressee of claims for incorrectly made deliveries.
  4. When receiving a Lot, the User should check the condition of the parcel. If the package is damaged or tampered with, a damage report should be drawn up in the presence of the courier and sent immediately to the Auction House together with a possible complaint.
  5. The Service Provider shall not guarantee the closing of Contracts for Sale and shall not be responsible for any physical or legal defects of Lots.

§ 12. COMPLAINTS

  1. All User's complaints regarding non-performance or improper performance of the Agreement by the Service Provider should be submitted electronically to the e-mail address: with a description of the complaint and reasons for its submission as well as with the identification data of the User submitting the complaint.
  2. The scope of the complaint shall exclude any defects, faults and irregularities resulting from:
    1. errors or mistakes by the User,
    2. malfunction of the web browser or telecommunication links on the part of the User,
    3. activities of third parties who do not participate in the provision of the Services through the Website on the initiative of the Service Provider.
  3. If the information provided in the complaint needs to be supplemented, before considering the complaint, the Service Provider shall ask the complainant to supplement it.
  4. The Service Provider shall consider the complaint within 14 days from the date of its receipt. If the complaint needs to be supplemented, this period shall start from the date of delivery of the supplemented complaint.
  5. The response to the complaint, including the manner of its consideration, shall be sent only to the e-mail address provided by the User. In particularly justified cases, including at the express request of the User who is a Consumer, the Service Provider shall send the response to the complaint to a different e-mail address or in writing to the indicated correspondence address.
  6. If the complaint is rejected, the User who is a Consumer shall have the possibility of using out-of-court complaint and redress methods. Information on out-of-court complaint and redress methods can be found at http://www.uokik.gov.pl.
  7. The Consumer may also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr. The platform serves to settle disputes between consumers and traders seeking to resolve out-of-court disputes concerning contractual obligations arising from an online sales or service contract.
  8. A dispute may also be considered by an arbitration court provided that the complaint procedure has been completed and both parties to the dispute agree to it. In other cases, any disputes may be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure and general jurisdiction.

§ 13. CONSUMER'S WITHDRAWAL

  1. The User who is a Consumer or Entrepreneur with Consumer Rights shall have the right to withdraw from a remote contract within 14 (fourteen) days of its conclusion without giving any reason, subject to sub-paragraph 2 of this paragraph.
  2. Auctions organised by Auction Houses, in which Users may participate using the Website, may be public auctions within the meaning of Article 2 (6) of the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2019, item 134, as amended). Pursuant to Article 38(11) of the same Act, Consumers or Entrepreneurs with Consumer Rights who are parties to a contract concluded by a public auction shall have no right to withdraw from that contract.

§ 14. PROTECTION OF PERSONAL DATA

  1. The use of the Website by the User involves the processing of their Personal Data by the Service Provider to the extent necessary for the provision of the Services offered.
  2. Users' Personal Data shall be processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) and the Act of 10 May 2018 on the Protection of Personal Data (Journal of Laws of 2018, item 1000).
  3. A User who has signed up on the Website shall have the right of access to the data, correct it, demand its erasure, as well as the right to restrict processing, object to the processing of personal data and lodge a complaint with the supervisory authority if the data is processed contrary to legal requirements. Data can be viewed and changed after logging on to the Website, within the User Account or by contacting the Service Provider at the e-mail address .
  4. Detailed rules regarding the processing of personal data are contained in the Privacy Policy on the Website.

§ 15. INTELLECTUAL PROPERTY RIGHTS

  1. When using the Website and accessing the content presented therein, the User shall be obliged to comply with the provisions of the Terms and Conditions, generally applicable legislation and not to undertake any actions which would constitute an infringement of intellectual property rights.
  2. The appearance of the Website and the content published on the Website, including in particular the content of Offers, which consists of, irrespective of its form, among others, graphic and text materials, logotypes and layouts, as well as the software ensuring its operation, shall be subject to protection of intellectual property rights, including the copyright of the Service Provider, Auction Houses or third parties. It shall be forbidden to use this content in any way, without the written consent of the right holders, on other websites as well as outside the Internet.
  3. The photographs of Lots made available on the Website as part of an Offer shall be protected by the copyrights of Auction Houses, which grant the Service Provider a licence to use them on the Website as part of the Offer and for marketing purposes. All claims related to any infringement of third-party copyrights to the photographs of Lots should be addressed directly to the Auction House.

§ 16. FINAL PROVISIONS

  1.  These Terms and Conditions shall be effective as of 12 March 2021.
  2. The Service Provider reserves the right to amend these Terms and Conditions at any time. Such amendment may be caused in particular by legislative changes or changes in the practice of applying the law, development of Internet technologies and changes in the rules of using the Website. The new terms and conditions shall enter into force as of the date of their publication on the Website on the subpage: "Terms and Conditions".
  3. Agreements concluded before the amendments to the Terms and Conditions shall be governed by the version of the Terms and Conditions in force on the date of conclusion of the Agreement.
  4. A change of the Service Provider's contact details contained in the Terms and Conditions or a change of his details resulting from a change in the legal form of his business shall not constitute an amendment to these Terms and Conditions.
  5. These Terms and Conditions shall neither exclude nor limit any rights of the User who is a Consumer or Entrepreneur with Consumer Rights, which they have under mandatory provisions of law. In the event of a conflict between the provisions of these Terms and Conditions and mandatory provisions of law granting certain rights to Consumers or Entrepreneurs with Consumer Rights, these provisions of law shall prevail.
  6. If any of the provisions of these Terms and Conditions is modified or invalidated by a decision of a competent authority or court, the remaining provisions shall remain in force and be binding on the User and the Service Provider.
  7. The agreement between the User and the Service Provider concerning the services provided within the Website under the conditions specified in these Terms and Conditions shall be governed by Polish law.
